OVERVIEW
Welcome to Darling Neptune (“we”, “us”, “our”). We operate this website and online store (the “Services”) to offer handmade, made-to-order artwork. Our store is powered by Shopify. By using the Services, you agree to these Terms of Service and our Privacy Policy.

1. ACCESS AND ACCOUNT
You must be 18 or over. You’re responsible for keeping account details secure and for all activity on your account. Information you provide must be accurate and complete.

2. OUR PRODUCTS (HANDMADE & MADE-TO-ORDER)
All pieces are handmade to order. Colours and natural materials may vary slightly from images. We may change or discontinue products at any time and may limit quantities.

3. ORDERS
When you place an order you make an offer to purchase. We accept when we email an order confirmation. Because items are made to order, we may be unable to cancel once production has started. If we cannot accept or must cancel an order, we’ll notify you and refund you promptly.
Your purchases are subject to our Returns Policy (made-to-order: faults only).

4. PRICES, TAXES & BILLING
Prices may change without notice. The price charged is the one shown at checkout/confirmation. Prices are in GBP. Shipping charges and any import duties/taxes for overseas orders are shown at checkout unless stated otherwise. You agree to keep your payment details current and authorise us to charge your chosen method for the order total.

5. SHIPPING, DELIVERY & RISK
Delivery times are estimates. We’re not liable for delays outside our control (we’ll keep you informed and take reasonable steps to minimise delay). Risk in goods passes to you only when the goods are delivered to you (or a person you nominate), unless you arranged your own carrier. Title passes on full payment.

6. INTELLECTUAL PROPERTY
All content on the Services is owned by Darling Neptune or our licensors and protected by law. You may use the Services for personal, non-commercial use only.
For personalised orders, you grant us permission to use any text or artwork you provide (e.g. names, dates, quotes) solely to create your item.

7. OPTIONAL TOOLS & THIRD-PARTY LINKS
Third-party tools or links are provided “as is”. We’re not responsible for their content, terms or policies, and your use is at your own risk.

8. RELATIONSHIP WITH SHOPIFY
We sell directly to you. Shopify powers our store but isn’t a party to your purchase and isn’t responsible for our sales or products.

9. RETURNS & CANCELLATIONS (MADE-TO-ORDER)
Because every piece is made to order or personalised, we cannot accept returns or cancellations for change of mind. This does not affect your rights where an item is faulty, damaged or not as described — in that case we’ll repair, replace or refund. Contact us at shop@darlingneptune.com.

10. FEEDBACK & REVIEWS
If you submit reviews or suggestions, you grant us permission to use them in our store or marketing.

11. ERRORS & OMISSIONS
We may correct errors or update information (including pricing and availability) at any time.

12. PROHIBITED USES
You must not use the Services unlawfully, to infringe rights, to upload malware, or to interfere with security or other users.

13. TERMINATION
We may suspend or terminate access for breach. You remain liable for amounts due up to termination.

14. DISCLAIMER & STATUTORY RIGHTS
Except as required by law, the Services and products are provided “as is” and “as available”. Nothing in these Terms limits your statutory rights.

15. LIMITATION OF LIABILITY
We do not exclude or limit liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. Subject to that, our liability for any order is limited to the price paid for the product.

16. GOVERNING LAW
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you live outside the UK, you also benefit from any mandatory consumer protections of your local law.

17. CHANGES TO THESE TERMS
We may update these Terms from time to time. We’ll post changes here and, where required, notify you. Your continued use of the Services means you accept the updated Terms.
